Rules
Rules that shape remodeling and building content
Where the license number applies, what a home for sale may not say, and what crew footage has to show.
Renovations carry the license number. New homes may not.
Suffolk County's home improvement definition in section 563-16 covers repair, remodeling, alteration, and additions to residential property but does not include the construction of a new home, and section 563-17(D) requires the license number in all home improvement advertising. Nassau County's definition likewise leaves out the construction of a new home building, and its rules require display advertising to carry the license number and full company name. A company that builds and renovates can need the number on one piece and not the other, so we put it on every piece unless your licensing office or attorney says otherwise.

Homes for sale and fair housing
The federal Fair Housing Act makes it unlawful to publish any notice, statement, or advertisement about the sale or rental of a dwelling that indicates a preference, limitation, or discrimination based on race, color, religion, sex, handicap, familial status, or national origin. A piece about a new build for sale describes the house and the work, never who it would suit.
Fall protection, on camera
OSHA's construction standard says each employee engaged in residential construction activities 6 feet or more above lower levels shall be protected by guardrail systems, safety net systems, or personal fall arrest systems, unless another provision allows an alternative measure. So crew working at height is filmed only with that protection in place.
The work shown has to be the work
Nassau County's home improvement rules say representations and illustrations of products or services offered to the public shall be accurately represented in all advertisements or descriptive material. So a before and after is your own job, shot as it is: no borrowed photos, and no rendering presented as finished work.
Written consent from everyone on camera
New York's Civil Rights Law section 50 makes it a misdemeanor to use a living person's name, portrait, picture, likeness, or voice for advertising or trade without their written consent, or a parent's or guardian's for a minor. That covers staff and customers alike, so a signed release comes before anyone appears in a piece.
