Why every plan stays on your own firm.

  • RESPA Section 8

    RESPA Section 8(a) prohibits giving or accepting a fee, kickback, or thing of value for referrals of settlement service business on a federally related mortgage loan. The CFPB's guidance treats gifts and promotions as things of value, and Regulation X allows normal promotional and educational activities aimed at a referral source if they are not conditioned on referrals and do not pay expenses the referral source would otherwise carry. A content plan about your own firm, paid for by your firm, is never something handed to a referral source.

  • New York's ban on inducements for title business

    New York's Department of Financial Services prohibits inducements for future title insurance business under Insurance Regulation 208 (11 NYCRR 228). The Appellate Division upheld that ban in January 2019, and DFS said in a circular letter that month that it remains in effect. One more reason the plan is about your firm and nobody else's.

  • Confidentiality in search stories

    A problem file makes the case for title insurance better than any brochure, but only with the identifying details gone. No names, addresses, parcel numbers, or images of real documents appear on screen.

  • Written consent from everyone on camera

    New York's Civil Rights Law section 50 makes it a misdemeanor to use a living person's name, portrait, picture, likeness, or voice for advertising or trade without their written consent, or a parent's or guardian's for a minor. That covers staff and customers alike, so a signed release comes before anyone appears in a piece.
